By this Publick Instrumt: of Protest, be it known, and manifest to all to whome the same shall come or hear it read, that on ye day of ye date hereof being the fifth of July, in ye fourth year, of ye Reign, of our Sovereign Lord, and Lady, William and Mary, King and Queen of England, Scotland, ffrance, Ireland and Virga: Annog Dom: 1692 Christopher Robinson Esqr: appeared before mee Francis Nicholson Esqr: their Majs: Lieut: Govr: and ye Honoble: their Majs: Council of this Colony and did then Exhibit (as he alledged) at ye Instance and Request of the Saywel a Charter Party of affraightmt: Indented and made the Seventeenth of Novembr: Anno: Dom: in ye third year ye Reign of said Sovereign Lord and Lady William and Mary by ye grace of god King and Queen over England &c: [illegible-torn] ye said Thomas Saywell Marrinr: & master & God of ye good Shipp or vessell called the Stephen and Edward of London, of ye burthen of two hundred Pounds or thereabouts and then Rideing at anchor, in ye River Thames of ye one party and ffrancis Lee of London Merchant for & on ye behalfe of Katherine ffauntleroy of Rappahannock river widow on ye other part wherein ye sd ffrancis Lee hath obliedged himself his hands, Executrs: administratrs: & assignes that Executors factors and assignes in Virga: shall within ye space of five and twenty dayes next after ye arrival of ye sd Shipp at Rappahannock River aforesaid & within Sufficient time wth.in ye said dayes, make ready & provide for ye sd: Shipp twenty hhds [hogsheads] of Tobb and give notice to ye sd Master, or his assignes where all ye said Tobacco shall go provided as by ye sd Charter Party doth at Large appear [due?] ye said Christopher Robinson Esqr. affirmeing yt ye sd Cha: Saywel alledges, the whole twenty five dayes are expired, and yt ye said ffrancis Lee and his factor failed to deliver ordrs: or give notice for the before mentioned Quantity of Tob: - Wherefore ye sd Christopher Robinson Esqr: hath in ye presence of mee their Majs: sd Lieut: Govr: & ye Council at ye Special Instance & Request of ye sd Tho: Saywell Protested, and by these Presents doth Protest as well against ye sd ffrancis Lee taker of ye sd ffraight, and Katherine ffaultleroy, as all others therein concerned, for all costs, Losses, damages & Interests whatsoever already suffered, or hereafter to be Suffered by reason of ye aforesd Charter Party not being complyed with and for as much as at this present time, there is no Publick Notary, appointed, & constituted , wthin this dominion ye sd Christopher Robinson Esqr: at ye Request of ye sd Tho: Saywell, hath thus done, & Protested, before thee their Majs: sd Lt: Govr: and the Council In faith and testimony whereof I have according to an order of Council in this behalf, have unto set my hand, & caused ye Seal of ye Colony, to be affixed, the day, and year, first menconed.
