Commth v John. Dep of wits

Seth B. French sworn deposed that on the [blank] day of September last witnesses house was forcibly entered and the goods mentioned in the mayor's certificate were stolen. Witness heard that John had committed the act and arrested him and he confessed that he had broken open the house at night by way of the windows and entered and John then told witness where the goods were and carried him to the coal cellar of Daniel Ratcliffe on Marshall Street where witness recovered the possession of the goods. Witness threatened to whip John and he then confessed the whole affair Witness resided in the house with his family. The house was entered about 11 oclock at night.

[For the defence. Daniel Ratcliffe sworn deposed that he hired the prisoner Lemuel and knows that he is a man of good character. Lemuel said that a man had given him the bundles to keep and he gave them up to Mr. French when he called for them.]
